General Terms and Conditions (GTC) for renting the vacation apartment “La Terraza Río y Mar” in Conil de la Frontera / Andalusia (direct booking / online transaction)

These Terms & Conditions govern the contractual relationship between the landlady and the guest for all bookings made via the website or electronically (e.g., email).

2. Rental Property, Registration & Purpose of Stay

The following accommodation is rented:

Holiday apartment

11140 Conil de la Frontera (Andalusia, Spain)

The apartment is rented exclusively for holiday and leisure purposes. Any other use (e.g., subletting, events/parties, commercial use without explicit consent) is not permitted.

3. Conclusion of Contract

A binding rental agreement is concluded when:

  • the guest places a booking (e.g., via the website or by email), and
  • the landlady confirms the booking in writing (email is sufficient).

By accepting the booking confirmation, the guest agrees to these Terms & Conditions as binding.

4. Prices, Included Services & Utilities

The total rental price and included services result from the booking confirmation.

4.1 Utilities included (standard stays)

Unless expressly agreed otherwise, for stays up to and including 60 days the following utilities are included:

  • Electricity
  • Water
  • Usual ancillary costs of use (e.g., community costs, where applicable)

4.2 Special rule for long stays over 60 days

For bookings with a stay of more than 60 days, electricity, water and/or ancillary costs may be charged additionally depending on agreement. The specific arrangement (flat rate or metered consumption) will be stated in the booking confirmation or a separate addendum.

5. Payment Terms

  • 30% deposit due at the time of booking
  • 70% balance due no later than 60 days before arrival

For bookings made within 60 days before arrival, the full amount is due immediately upon booking.

If payment is not made on time, the landlady is entitled to cancel the rental contract. In this case, the cancellation terms in section 6 apply; the guest remains liable for amounts due according to the cancellation policy.

6. Cancellation Policy

Cancellations must be made in writing (email is sufficient). The effective date is the date the cancellation is received by the landlady.

  • Cancellation 60 days or more before arrival:
    Refund of 50% of the deposit (equals 15% of the total price)
  • Cancellation 30 days or more before arrival:
    50% of the total price is refundable
  • Cancellation 14 days or more before arrival:
    25% of the total price is refundable
  • Cancellation up to and including the day of arrival (0 days before arrival):
    15% of the total price is refundable
  • Later cancellation or no-show:
    No refund

The guest is advised to take out travel cancellation insurance.

7. Security Deposit

A refundable security deposit of EUR 200.00 is due for the duration of the stay.

The deposit serves to cover damages to the apartment, its furnishings, or breaches of these T&Cs/house rules (e.g., unauthorised pets, occupancy violations, excessive soiling).

If no issues are identified, the deposit will be refunded after departure.

8. Arrival / Departure & Keys

  • Check-in: from 14:00 (2:00 pm)
  • Check-out: by 11:00 (11:00 am)

Deviations are only possible by prior agreement.

In case a key or remote control is lost, the guest bears the replacement costs and, if necessary, any locksmith costs, if such services are required.

9. House Rules

  • Pets: generally not permitted. Pets are only allowed with prior explicit approval by the landlady.
  • Maximum occupancy: 4 persons. Over-occupancy is strictly prohibited.
  • Quiet hours: must be respected, especially during night-time.
  • Check-in / check-out times: must be adhered to.
  • Care of the property: the apartment must be treated with care and kept in an orderly condition.

Breach of the house rules may—depending on severity—lead to immediate termination of the rental agreement without entitlement to a refund.

10. Guest Responsibilities / Damages

The guest is liable for all damages caused by the guest, co-travellers or visitors, including consequential damages (e.g., damage to furniture, equipment, technical installations, excessive soiling, and occupancy violations).

Any damage must be reported to the landlady without delay.

11. Force Majeure (Fuerza Mayor)

If the apartment cannot be used or can only be partially used due to force majeure events beyond the landlady’s control that were not foreseeable or preventable, no claim for damages shall arise.

Force majeure includes, in particular, natural disasters, extreme weather events, fire, flooding, pandemics/epidemics, official orders or prohibitions of use, official travel restrictions, war, and other extraordinary circumstances that objectively make contractual use of the accommodation impossible.

In such a case, payments already made will be refunded pro-rata for the period during which the apartment was objectively unusable. Further claims—especially claims for damages, travel costs or consequential costs—are excluded to the extent permitted by law.

If use becomes permanently impossible, either party is entitled to withdraw from the contract.

12. Liability of the Landlady

The landlady is liable within the framework of the applicable statutory provisions. Liability for the guest’s personal belongings (loss/theft) is excluded to the extent permitted by law.

The landlady is not liable for disruptions beyond her control (e.g., general electricity/water/network outages, force majeure), to the extent permitted by law.

13. Data Collection & Legal Reporting Obligations (SES Hospedajes)

The guest is informed that, under Spanish legal requirements, guests’ personal data must be collected and transmitted to the competent authorities via the legally required reporting system (SES Hospedajes).

The guest undertakes to provide the required information truthfully (e.g., identification details). Processing is carried out solely to comply with legal obligations and to perform the rental agreement.

14. Language / Prevailing Version

If these Terms & Conditions are provided in multiple languages, the Spanish version shall prevail in case of discrepancies, if such a Spanish version is made available.

15. Applicable Law & Jurisdiction

Spanish law shall apply exclusively.

Jurisdiction shall be—where legally permissible—the place where the rental property is located.

16. Severability Clause

If any provision of these Terms & Conditions is or becomes invalid in whole or in part, the remaining provisions remain unaffected. The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the invalid provision.
